CALIFORNIA58 | PROPERTY RIGHTS | OCTOBER 18, 2026. A buyer can acquire a California parcel and later discover that a previous owner reserved some or all rights to minerals beneath the surface. The distinction between surface ownership and mineral rights can matter for rural land, particularly where a property has a history of mining, oil and gas activity or recorded deed exceptions.
Can mineral rights belong to someone else?
Yes. Depending on the property’s history and the language of recorded instruments, ownership interests in the surface and subsurface may have been separated. A deed can convey the land subject to a reservation or exception. Buyers should not assume that an assessor parcel number or a listing’s acreage description establishes ownership of every subsurface interest.
What to read in a preliminary title report
Ask the title company for the legal description and the recorded documents supporting any exceptions for minerals, oil, gas, mining rights, access or easements. A preliminary title report is a starting point; it is not a complete geological or legal investigation. Older reservations can use technical language, and their effect may require a real-estate attorney or title specialist to interpret.
Six questions to ask before buying
- What exactly is being conveyed? Read the current deed and relevant earlier instruments rather than relying on the listing.
- Are mineral interests reserved? Request copies of the recorded documents, not merely a summary line.
- Do recorded rights include surface access? The scope of any right to enter, use roads or conduct operations depends on the governing instruments and law.
- Are there active or historic operations? Investigate mines, wells, shafts, pits, tailings and potential environmental conditions as relevant.
- Are there government-held interests? Some lands have federal or state ownership or reservation histories that require separate research.
- Will the intended use be affected? Ask qualified professionals about building placement, insurance, financing, access and potential conflicts.
How to check for oil and gas wells
The California Geologic Energy Management Division (CalGEM) publishes regulatory information and tools for oil and gas wells. Its records can help identify reported well locations and statuses, but a map search alone does not establish mineral ownership or prove that every historical condition has been identified.
How to research mining claims and land records
The Bureau of Land Management’s land-records resources are a starting point for federal land and mining-claim research where applicable. County recorder records, recorded deeds, title exceptions and historical documents may be necessary for private-property questions. The California Department of Conservation’s Division of Mine Reclamation provides information on mine reclamation oversight and related resources.
Does a mineral reservation mean someone can immediately drill or mine?
Not necessarily. Rights and restrictions vary by the wording of the instrument, ownership, applicable law and required governmental approvals. Do not treat a mineral reservation as proof that extraction is planned, nor assume it can never affect the surface. A parcel-specific legal review is the appropriate way to evaluate the risk.
Before closing
Make the purchase contingent on a satisfactory title and property investigation when appropriate. Ask for recorded documents early enough to consult a qualified California real-estate attorney, title professional, geologist or environmental specialist if the history warrants it. Also check the property’s legal-parcel status, survey boundaries and legal access.
